Milwaukee Roundup Injury Claims Attorney

Have You Developed Cancer Due to Roundup Exposure?

The weed killer Roundup is likely the most popular and widely used herbicide in the U.S. Originally developed by Monsanto, it has mostly been used by farmers as well as landscapers, nursery personnel, and home and community gardeners. Until recently, these individuals used the product without warning of its potential risks.

Now it is known and has been stated by such agencies as the World Health Organization that it is a likely human carcinogen. Findings by the International Agency for Research on Cancer revealed that glyphosate, a component in Roundup, kills human cells. Because of its deadly ingredient, Roundup has become the target of approximately 100,000 claims by individuals who developed lymphomas after using the product.

Roundup Claim Settlement Deal by Bayer

In June 2020, Bayer, the German pharmaceutical company that bought Monsanto, agreed to a $10 billion deal to resolve approximately 100,000 injury claims made against it. According to claimants, exposure to Roundup caused their deadly lymphomas, such as Non-Hodgkin’s lymphoma and chronic lymphocytic leukemia. Despite controversy over its main ingredient of glyphosate, neither Monsanto nor Bayer provided warnings on its label about its potential health risks. Monsanto first began selling the product in 1974. Since then its use has increased substantially.

When the deal was announced, the majority of the settlement was designated for current claims. However, $1.25 billion was set aside by Bayer to resolve future claims of individuals asserting that they have suffered lymphomas due to their use of the product. Additionally, a portion of the $1.25 billion has been set aside for an independent panel of experts to make a decision as to whether glyphosate leads to cancer and the degree of glyphosate exposure that puts someone at risk.

Compensation in injury cases such as these may include:

  • Medical expenses for cancer treatments that you have undergone in the past as well as those expected for the future
  • Pain and suffering
  • Lost wages or income due to the inability to work
  • Emotional anguish

For those who have lost a loved from a Roundup-related lymphoma, compensation can include funeral and burial expenses, loss of care, comfort, companionship, and financial support as well as other damages dependent on the circumstances of your case.

Bayer Loses at Trial

In three previous trials involving these claims, juries sided with claimants concluding that Roundup contributed to the plaintiff’s cancer claims. The verdicts resulted in billions of dollars awarded to plaintiffs in damages. The amounts of these damages were later reduced by judges. However, the verdicts for the plaintiffs remained. Since then, Bayer’s appeals to have the verdicts reversed have been unsuccessful.

Deceptive Practices by Monsanto

Evidence discovered at the trials revealed Monsanto’s deceptive practices used to hide the carcinogenic risks of exposure to Roundup. These practices included failure to test the carcinogenic toxicity of the Roundup formula, seeking favor with EPA officials for backup in its ruling that Roundup is safe, and secret funding to consumer advocacy groups such as The American Council on Science and Health to reassure public trust in the product.
